1. Introduction
These Enquiry Terms and Conditions (“Terms”) apply when you submit an energy or home-improvement enquiry through an online enquiry form powered by Flex Energi (“Flex Energi”, “we”, “us”). The form may be hosted on a third-party website and branded for the installer or business receiving your enquiry (“Enquiry Recipient”).
By ticking the consent box and submitting your enquiry, you confirm that you have read and agree to these Terms and our Privacy Policy.
2. Parties and roles
Enquiry Recipient. The Enquiry Recipient is the installer or business whose name appears on the enquiry form. They receive your enquiry to assess your property, discuss suitable measures, and provide quotations or follow-up services.
Flex Energi. Flex Energi provides the technology platform that hosts the enquiry form, processes submissions, and may analyse, store, and commercially use enquiry data as described below. Flex Energi acts as a data controller in respect of platform processing and as a data processor where it processes data solely on behalf of the Enquiry Recipient, in accordance with applicable data protection law.
3. Information we collect
When you submit an enquiry, we may collect:
- Contact details (name, email address, telephone number)
- Property address and location data (including coordinates where provided)
- Property characteristics (dwelling type, bedrooms, tenure, occupancy patterns)
- Energy usage information and measure preferences
- Technical or survey-related data derived from third-party sources (for example EPC or solar roof data)
- Submission metadata (referring website, page URL, session identifier, and similar technical data)
4. How your information is used
Your information may be used to:
- Process and respond to your enquiry
- Allow the Enquiry Recipient to contact you about suitable products, services, surveys, and quotations
- Assess property suitability for renewable energy or efficiency measures
- Improve enquiry handling, customer experience, and platform functionality
5. Flex Energi platform processing and analysis
Flex Energi may store, organise, analyse, and report on enquiry data for legitimate business purposes, including service delivery, fraud prevention, quality assurance, aggregated statistical analysis, product development, and platform improvement. Where data is aggregated or anonymised, it may be used without identifying you personally.
6. Sharing, licensing, and commercial use of data
With your explicit consent (given by accepting these Terms), Flex Energi and/or the Enquiry Recipient may share, license, or sell your enquiry data (including personal data) to carefully selected third parties where this supports energy-related products and services. These may include, without limitation:
- Other MCS-certified installers or contractors
- Manufacturers and distributors of renewable energy or efficiency products
- Finance, insurance, or energy service providers
- Lead generation or referral partners operating in the home energy sector
Any such sharing will be limited to purposes reasonably connected with home energy, efficiency, or related property improvements. Third parties receiving your data are expected to handle it in accordance with applicable data protection law and their own privacy notices.
7. Marketing communications
The Enquiry Recipient and, where permitted, Flex Energi or its partners may contact you by email, telephone, SMS, or post about your enquiry and related products or services. You may withdraw consent for marketing at any time without affecting the lawfulness of processing before withdrawal.
8. Legal basis for processing
We rely primarily on your consent (Article 6(1)(a) UK GDPR) for the processing described in these Terms, including commercial sharing of your data. We may also rely on legitimate interests (Article 6(1)(f)) for limited purposes such as fraud prevention, security, and aggregated analytics that do not override your rights.
9. Data retention
Enquiry data is retained for as long as necessary to fulfil the purposes described in these Terms, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods may vary depending on whether data is held by Flex Energi, the Enquiry Recipient, or a third party recipient.
10. Your rights
Under UK data protection law, you have rights including access, rectification, erasure, restriction of processing, data portability, and objection to processing. Where processing is based on consent, you may withdraw consent at any time.
To exercise your rights or withdraw consent, contact us at [email protected]. You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO).
11. Security
We implement appropriate technical and organisational measures to protect enquiry data. However, no method of transmission over the internet is completely secure, and we cannot guarantee absolute security.
12. No obligation
Submitting an enquiry does not create a contract for installation or purchase. Any quote or proposal offered by the Enquiry Recipient is subject to separate terms agreed between you and that business.
13. Changes to these Terms
We may update these Terms from time to time. The version in force at the time you submit your enquiry applies to that submission. Material changes will be reflected in an updated version number.
14. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, subject to any mandatory rights you may have as a consumer.
15. Contact
Questions about these Terms or how your data is handled may be sent to [email protected].
